Notice of Enactment Ordinance 2026-2

NOTICE

To the electors and residents of the Village of Rochester,

Racine County, Wisconsin and to all parties in interest:

 

Please take notice that the Village Board of the Village of Rochester, Racine County, Wisconsin, did, pursuant to law, on the 11th day of May, 2026, duly enact a certain ordinance to amend Chapter 35 of the Municipal Code to permit accessory structures in certain street yards and to clarify how zoning ordinances may be initiated.

 

Please take further notice that said ordinance was passed by the vote of said Village Board.

 

Please take further notice that hereafter set forth is a summary of said Ordinance as enacted. The full text is available in the Village Clerk’s office during regular office hours.

ORDINANCE NO. 2026-2
Amending the Zoning Code of the Village of Rochester to Permit Accessory Structures in Some Street Yards and Clarify How Zoning Ordinances May be Initiated

The Village Board of the Village of Rochester, Racine County, Wisconsin, do ordain as follows:

Section I. Amends Chapter 35, Section 35-180(B)(6), regarding yard modifications, to allow accessory structures in the street yards of residential properties in agricultural districts under certain conditions, including setback requirements based on adjacent principal structures or zoning district requirements.

Section II. Amends Chapter 35, Section 35-21(B)(2)(b), by repealing and recreating provisions related to accessory structures on sewered lots to remove references to Section 35-180(B)(6) and clarify size, setback, and use limitations for detached accessory structures.

Section III. Amends Chapter 35, Section 35-220(B), to clarify that zoning amendments may be initiated by the Village Board, Plan Commission, Historic Preservation Committee, Ordinance Committee, Village Staff, or by petition in the case of map amendments only.

Section IV. Amends Chapter 35, Section 35-220(C), to clarify that petitions apply only to zoning map amendments and must include a description of the property and justification for the requested change.

Section V. Provides that the provisions of this ordinance shall be considered a continuation of existing ordinances where applicable and shall not affect any pending actions, rights, or liabilities incurred prior to its enactment.

Section VI. Provides that the provisions of this ordinance are severable and that invalidity of any portion shall not affect the remaining provisions. Conflicting ordinances are repealed only to the extent of such conflict.

Section VII. Indicates that the ordinance shall take effect after passage and posting as provided by law.
