NOTICE
To the electors and residents of the Village of Rochester,
Racine County, Wisconsin and to all parties in interest:
Please take notice that the Village Board of the Village of Rochester, Racine County, Wisconsin, did, pursuant to law, on the 13th day of April, 2026, duly enact a certain ordinance to amend Chapter 3 of the municipal code to require notification to Racine County Sheriff’s Department for all non-recreational burns within the Village of Rochester.
Please take further notice that said ordinance was passed by the unanimous vote of said Village Board.
Please take further notice that hereafter set forth is a summary of said Ordinance as enacted. The full text is available in the Village Clerk’s office during regular office hours.

ORDINANCE NO. 2026-4
Amending Chapter 3 of the Municipal Code of the Village of Rochester
to Require Notification to the Racine County Sheriff’s Department for All Non-Recreational Burns
The Village Board of the Village of Rochester, Racine County, Wisconsin, do ordain as follows:
Section I. Repeals and recreates Section 3-11(G)(5), summarized as follows:
3-11. Outdoor and Refuse Burning.
Provides that open burning of weeds or brush on agricultural lands may begin at 8:00 a.m. provided dense smoke is not created and all other applicable regulations are followed. Requires advance notification to the Racine County Sheriff’s Department for all non-recreational burns. Clarifies that the 8:00 a.m. start time applies only to agricultural field burning and not to refuse burning, burn barrels, or other types of burning.
Section II. Provides that the provisions of this ordinance are severable and that invalidity of any portion shall not affect the remaining provisions.
Section III. Indicates that the ordinance shall take effect after passage and publication as provided by law and that all other language in the Municipal Code shall remain without change and in full force and effect.
