October 28, 2020 Plan Commission Meeting *Updated Notice

Notice is hereby given that a meeting of the Plan Commission will be held Wednesday, October 28, 2020 at 6:00 p.m.

Due to COVID 19 transmission concerns, the Village requires that all participants attending tonight’s meeting on the Oak Knoll Cell Tower wear face masks.   Social Distancing measures will be in place.  The capacity of the Rochester Village Hall is limited.   Overflow attendees will be directed to two alternate locations to participate in the meeting via video conference.

We encourage anyone who is not speaking at the meeting to view and/or listen to this meeting at an alternative location by utilizing the following video or telephone conferencing information:

The Plan Commission is required to make decisions on conditional uses based on substantial evidence introduced at the hearing.   “’Substantial evidence” means facts and information, other than merely personal preferences or speculation, directly pertaining to the requirements and conditions an applicant must meet to obtain a conditional use permit and that reasonable persons would accept in support of a conclusion.” 

Speakers at the hearing are encouraged to provide substantial evidence as described in the State law. 

The Plan Commission asks that all testimony be limited to NEW information only. 

Testimony has or will be introduced into the record addressing the following concerns:

·         Application Requirements

·         Conditional Use Requirements

·         Adverse Aesthetic Impacts

·         Loss of Property Values

·         The need for the tower at the requested height (both for and against)

·         Coverage needs in the area (both for and against)

·         Review of alternative locations (both for and against)

·         Safety concerns and documented tower failures

·         Rustic Road designation and applicable administrative guidelines

·         Historic Site review requirements

·         The impact on local wildlife, most notably the migratory bird population

To date, five speakers have registered to speak which represent a citizen group opposing the application.   The applicant will also be attending with additional information supporting the application. 

Sign up forms will be available at the meeting which will allow individuals to record their name and address and indicate whether they are for or against the application.   This information will be read into the record.  You may also submit an email to the Village Administrator with this same information at [email protected]

Email submittals will be taken until 5:00 p.m. today.

If you have signed a petition regarding the application and it has been submitted to the Village, your opposition is already on record and has become part of the materials the Plan Commission will consider at the hearing.
